Registering or Cancelling a Bond
Bond Registration
The Bank or Company/person lending the money normally applies for the bond or charge to be registered as an adverse entry on the Land Register. The Applicant needs to complete a Land Registry Form A which is lodged with one signed original and one copy of the legal charge/bond. A proof of identity Form C (for an individual) or Form D (for a body corporate) is also required for the borrower. The Land Registrar does not require a Form D for the lender where the bond is provided by a recognised High Street Bank. If this is not the case then the lender also needs to complete a Form C or D. A Land Registry fee applies to registration of a bond.
Bond Cancellation
A property owner who wishes to cancel a bond or charge should ask the Lender to apply for the bond to be cancelled. A Form A needs to be submitted with the original legal charge/bond attached for cancellation. A proof of identity Form C (for an individual) or Form D (for a body corporate) must also be completed for all parties to the bond. The Land Registrar does not require a Form D for the lender where the bond is provided by a recognised High Street Bank. A Land Registry fee applies to cancellation of a bond.
